Off the Grid, Not Above the Law: What Preppers Get Wrong About Radio Privacy
There's a persistent idea floating around prepper forums and survivalist communities that goes something like this: When things go sideways, the rules don't matter anymore. It's an understandable instinct. But here's the thing—most people planning for emergencies aren't planning for a full societal collapse. They're planning for hurricanes, ice storms, power outages, and the kinds of disruptions that happen regularly in the real world. And in that real world, the FCC still exists, licensed amateur radio operators are still bound by Part 97 of the Code of Federal Regulations, and "I thought it was an emergency" is not a legal defense.
So let's talk about the intersection of radio, privacy, and the law—because it's messier and more interesting than most people realize.
The Big Myth: Ham Radio and Encryption
If you've spent any time in prepper radio circles, you've probably heard someone suggest using encrypted communications on amateur radio frequencies. It sounds logical—you want secure comms, ham radio has great range and flexibility, so why not combine the two?
Because the FCC explicitly prohibits it.
Section 97.113(a)(4) of FCC rules states that amateur radio operators may not transmit "messages encoded for the purpose of obscuring their meaning." That's not a gray area. It's a flat-out ban on using encryption to hide the content of your transmissions on ham frequencies. The whole philosophical backbone of the amateur radio service is openness—the idea that communications should be accessible, transparent, and community-oriented. Encryption runs directly against that grain.
Now, there's a subtle distinction worth noting: data compression and forward error correction aren't the same as encryption. Digital modes like JS8Call, Winlink, and even some packet radio protocols encode data, but not to obscure meaning—they do it for efficiency and error correction. That's generally fine. The moment you're intentionally hiding the content of a message from anyone who might be listening, you've crossed the line.
What About GMRS, FRS, and Other Licensed Services?
This is where things get more nuanced—and honestly, more useful for the privacy-minded communicator.
General Mobile Radio Service (GMRS) licenses are issued by the FCC and cover a family of UHF frequencies. Unlike ham radio, GMRS doesn't have the same blanket prohibition on encryption. However, that doesn't mean you can just slap any encrypted protocol on a GMRS radio and call it legal. The FCC still requires that GMRS communications be used for "personal or business activities"—not for obscuring communications in ways that could interfere with or harm other users.
Commercial Land Mobile Radio (LMR) systems—the kind used by businesses, security firms, and public safety agencies—can and do use encryption legally. Systems like Digital Mobile Radio (DMR) with privacy features, P25 Phase 2, and NXDN all offer encryption capabilities within their licensed frameworks. But these operate under different FCC licensing categories (Part 90), and getting properly licensed for them takes more than a Technician exam.
The bottom line: if you want encrypted radio communications, you need to be operating under a license category that permits it, on frequencies allocated for that purpose. Ham radio is not that.
The Practical Alternatives for Security-Minded Operators
So what can you do if you want a degree of privacy in your emergency communications plan?
Go commercial with proper licensing. A business band license (Part 90) opens up options for encrypted digital radios. Motorola's DMR lineup, Kenwood's NXDN radios, and similar commercial systems offer genuine encryption when configured properly. Yes, it takes more paperwork and upfront cost—but it's legal, reliable, and built for exactly this kind of use case.
Use spread spectrum or frequency hopping on unlicensed bands. Certain Part 15 devices operate on spread-spectrum technology, which doesn't encrypt in the traditional sense but does make interception significantly harder. Some tactical-style radios marketed to the outdoor and security community use this approach. Just know the power limitations are strict, and range will be modest.
Leverage internet-linked systems as a supplement. Platforms like Zello, Meshtastic (running on LoRa radios), and encrypted mesh networking apps can provide genuinely private communications—but they rely on internet or cellular infrastructure. For true off-grid use, Meshtastic is worth exploring: it runs on unlicensed ISM band frequencies and supports end-to-end encrypted messaging between nodes.
Embrace PACE planning with layered communication. The military concept of Primary, Alternate, Contingency, and Emergency (PACE) communication planning doesn't require encryption to be effective. By using multiple systems—ham radio for wide-area coordination, GMRS for family/neighborhood comms, and a mesh device or satellite communicator for sensitive messaging—you get redundancy and functional privacy without breaking any rules.
The Frequency of Misunderstanding
Part of the reason this issue keeps coming up is that a lot of radio gear marketed toward preppers and survivalists exists in a legal gray zone—or is outright marketed irresponsibly. You've probably seen "military-style" radios on Amazon with vague claims about encryption or "secure channels." In most cases, these are either basic scrambling (easily defeated, and still potentially illegal on ham bands) or marketing fluff with no actual security function.
Real security professionals—whether they're managing communications for a disaster response team or coordinating a neighborhood emergency network—don't rely on obscurity or gray-market gear. They use properly licensed equipment, established protocols, and training.
Keeping It Legal Without Sacrificing Capability
Here's the honest takeaway: you don't need to break the law to build a capable, resilient communication system. The legal options available—ham radio for wide-area coordination and community connection, GMRS for family and local comms, commercial LMR for encrypted business-class communications, and supplemental mesh or satellite devices—cover virtually every scenario a prepared household or community group would realistically face.
The FCC rules that constrain ham radio encryption aren't arbitrary bureaucratic obstacles. They reflect a genuine philosophy about what amateur radio is for. And within those rules, there's an enormous amount of capability available to anyone willing to get licensed, get trained, and get serious.
Gear up smart. Know the rules. The radio freedom you're looking for is probably already legal—you just might be looking in the wrong place.
